This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable.

This Platform (vidup.in) is owned and operated by Artfina, with its registered office at Kharghar, Panvel 410210, Maharashtra, India (hereinafter referred to as ‘Platform Owner’, ‘we’, ‘us’, ‘our’). By accessing or using VidUp, you agree to be bound by these Terms.

1. Use of Platform

You agree to provide true, accurate and complete information during registration. You are responsible for all activity under your registered account. VidUp reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

2. Services

VidUp is a digital SaaS tool for YouTube creators. We provide AI-generated content suggestions including titles, hook scripts, and thumbnail ideas. All services are delivered digitally - there are no physical products, shipping, or delivery involved. Generated output is provided as a creative starting point and does not guarantee any specific results.

3. No Warranty

We do not guarantee that AI-generated output will result in specific views, subscribers, or revenue. Content suggestions are provided as-is. Use your own judgment before publishing any generated content. YouTube algorithm changes, audience behavior, and content quality are outside our control.

4. Credits and Payments

  • Credits are purchased to use VidUp's generation features
  • Free credits (2 per month) reset on your monthly anniversary date
  • Purchased credits never expire and stack with existing credits
  • Credits are non-transferable and have no cash value outside the Platform
  • By purchasing credits you enter into a legally binding contract with Artfina
  • All payments are processed securely via PhonePe

5. Intellectual Property

The Platform, its design, technology, and brand are proprietary to Artfina. Generated output (titles, scripts, thumbnail concepts) belongs to the user who generated it. You may use it freely for your YouTube content. VidUp retains the right to use anonymous, non-attributable data to improve the generation system.

6. Prohibited Use

  • Using VidUp for any unlawful purpose or in violation of Indian laws applicable to you
  • Generating illegal, harmful, or defamatory content
  • Attempting to reverse-engineer, copy, or abuse the service
  • Creating multiple accounts to circumvent credit limits
  • Using VidUp to generate spam or mass low-quality content

7. Third Party Links

VidUp may contain links to third-party websites including YouTube, Pinterest, and Canva. We are not responsible for their content, availability, or privacy practices. Accessing third-party links is at your own risk.

8. Indemnification

You agree to indemnify and hold harmless Artfina, its officers, directors, and employees from any claims, damages, or expenses arising from your use of VidUp, your breach of these Terms, or your violation of any rights of a third party.

9. Force Majeure

Neither party shall be liable for failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, government restrictions, internet outages, or third-party service failures.

10. Account Termination

VidUp may suspend or terminate accounts that violate these Terms without notice. You may delete your account at any time from your profile settings. Upon deletion, your personal data will be removed within 30 days.

11. Governing Law

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Panvel, Maharashtra.
